Term & Conditions
These Terms and Conditions govern your use of services provided by New York Music Center, Inc. (“the School”, “we”, “us”). By enrolling in any program or service, you agree to these Terms and Conditions.
For students under 18, all agreements and communications are made through a parent or legal guardian, who assumes full responsibility for the student’s participation.
Enrollment and Payment
Payment for tuition, fees, and any other charges must be made by the specified due dates. Failure to do so may result in cancellation of enrollment or additional charges.
By enrolling, the student or parent/guardian authorizes the School to charge the selected payment method for tuition and applicable fees according to the chosen payment plan.
Tuition rates and fees are subject to change without prior notice.
Enrollment is subject to availability and approval by the School.
The School may modify instructors, schedules, or program structure when necessary to ensure continuity of instruction or operational needs. Requests for specific instructors are not guaranteed.
Enrollments are based on a semester system and may only be withdrawn between semesters.
Semesters:
Fall: September – January
Spring: February – June
Summer: July – August
Semester payments may be prorated depending on start date. Except where explicitly stated, partial attendance does not entitle students to prorated tuition or refunds.
There is no transfer of tuition between months or semesters.
A $75 annual registration fee applies to all students.
Tuition & Payments
Tuition is non-refundable once enrollment is confirmed for the semester. This applies regardless of attendance, schedule changes, or early withdrawal. A trial lesson with no commitment is offered to all new students prior to enrollment to ensure program suitability.
Payment plans may be available, but full semester tuition remains due.
Late payments may incur additional fees.
Repeated missed payments may result in a requirement to pay the full remaining semester balance.
Attendance and Cancellations
Lessons cancelled with less than 24 hours’ notice will be charged in full and are not eligible for make-up lessons.
For lessons cancelled with at least 24 hours’ notice, up to two make-up lessons per semester are guaranteed. Make-up lessons must be scheduled within the same semester and are subject to availability.
Missed lessons without proper notice are not eligible for make-up lessons.
The same cancellation and make-up policy applies to both in-person and online lessons. Technical issues, internet connectivity problems, or equipment failures on the student’s side do not constitute excused absences and are not eligible for make-up lessons unless otherwise agreed by the School.
Students are responsible for attending all scheduled lessons. The School is not obligated to provide reminders for either online or in-person lessons.
School Cancellations & Substitutions
If the School cancels a lesson, the School may, at its discretion, provide either a substitute teacher or an alternative make-up date with the original teacher within the same semester.
The School reserves the right to assign or substitute instructors at any time to ensure continuity of instruction. Requests for specific instructors are not guaranteed.
No refunds are issued for School cancellations.
Conduct
Students are expected to behave respectfully at all times and to comply with School rules and policies.
The School may, at its discretion, suspend or terminate enrollment in cases of behavior deemed inappropriate, disruptive, unsafe, or otherwise detrimental to the learning environment. In such cases, no refunds will be issued.
The School reserves the right to make final determinations regarding conduct, safety, and enforcement of policies.
Photography and Media Use
The School may take photographs or video recordings during lessons, classes, recitals, or events for educational and promotional purposes, including use on the School’s website, social media, and printed materials. Families who prefer not to be included in any photographs or recordings may notify the School in writing at any time to opt out of media use.
Lesson Recording (Optional Operational Use)
Lessons may be recorded for educational, quality assurance, or training purposes. By participating, students consent to such recordings unless otherwise agreed in writing.
Official Communications
All official communications, cancellations, and requests must be submitted in writing via email to the School. Verbal communications are not considered binding.
Nondiscrimination Policy
The School does not discriminate on the basis of sex, race, color, religion, national origin, citizenship status, age, marital status, pregnancy, disability, or sexual orientation in its employment practices, admissions, educational programs, financial aid, or any School-related activities. The School is committed to providing equal opportunity and an inclusive environment for all students, families, faculty, and staff.
Liability
The School is not responsible for injury, loss, or damage except in cases of gross negligence or willful misconduct.
Force Majeure
The School is not responsible for any failure or delay in providing services due to events beyond its reasonable control, including but not limited to natural disasters, illness outbreaks, government restrictions, or technical failures.
Intellectual Property
All materials and content are the property of the School and may not be reproduced without written permission.
Governing Law
These Terms are governed by the laws of the State of New York.
Any disputes shall be resolved exclusively in the courts of New York.
Entire Agreement
These Terms and Conditions constitute the entire agreement between the student (or parent/guardian) and the School and supersede any prior agreements or understandings.
Changes to Terms
These Terms may be updated at any time. Updated Terms become effective upon publication on the School’s website.
Terminate Services
The School reserves the right to refuse enrollment, suspend participation, or terminate services in cases involving non-payment, repeated policy violations, disruptive or unsafe behavior, failure to comply with School procedures, or conduct deemed detrimental to the School environment. Refunds or credits may be denied in accordance with School policies.
Acceptance
By enrolling in any program, you confirm that you have read, understood, and agree to these Terms and Conditions.
